A divorce leaves no one in the family untouched. Mother, father, children, grandparents and cousins – everybody will need help of some kind in a divorce. If the couple that is having the divorce are on common ground the divorce can be relatively easy, but if they, on the other hand, are arguing and can´t come to terms with even the smallest decision, everything will be so much harder for everyone involved.
When is a divorce possible?
To be able to get legally divorced the marriage must be irretrievably broken down in the sense of the law. For this to be accomplished there must be a valid reason and as such you can count adultery and unreasonable behaviour. If your partner leaves without contact, you can get a divorce after two years. If you have separated and been apart for two years or if the divorce is contested for five years it is also legally possible. If one or more of these reasons are fulfilled, you can proceed with the divorce.
How do I get divorced?
The first step towards divorce is to fill out a divorce petition. If there are children in the marriage, there is also a statement required on the arrangements for the children. The documents will be issued by the court and sent to the other part for acknowledgement. If the respondent doesn´t acknowledge it, you can need to use a service to get it on paper that the documents have been acknowledged. If there are no objections or other suggestions made, the papers will go to a judge that will consider both parts and then issue the divorce. if there are no obstacle, six weeks after decree (the decision of the judge) the divorce will be final. Estimated time for a divorce is about six months from beginning to end. This can of course vary if there are financial issues or if the couple can´t decide on how to split, but this is the time it usually takes.
Issues between parties
When you get married you can hardly think that there could be any problems between you and your beloved one, but unfortunately most divorces are not too friendly. There are lots of things that can create problems in what used to be a happy marriage. The most common thing to create problems is money, who shall have the most? Who has the biggest needs and who will pay for the children? Who has earned the most and who has spent the most? There are many questions to be answered in this difficult time. Mostly the man in a marriage is the one who has earned the most money, but this is mostly put in relation to what the woman has done instead, like taking care of children and the home. If the woman is to have the children most after the divorce, she is likely to get more of the common money as well since children cost a lot. This is just the beginning of how a divorce is handled, we will have many reasons to get back to the subject but for now we have gone through the bases and how to get the divorce started. Best of luck and hope for a friendly and simple divorce!
